Executuve Orders

I would like to point out to certain people that the Emancipation Proclamation was an executive order. Executive orders have been used by every president since Washington. Theodore Roosevelt issued over 1.400 executive orders. Truman used an EO to desegregate the military. Kennedy and Johnson handed down EOs to bar racial discrimination in federal housing, hiring, and contracting. The authority for EOs is in Sections 1 and 3 of Article II of the Constitution, which read in relevant parts as follows: 1. The executive Power shall be vested in a President of the United States of America; and 3. he [the President] shall take Care that the Laws be faithfully executed. There already are laws regarding immigration. They just needed, shall we say, help. There were no laws covering the subject matter of the Emancipation Proclamation and if the people had waited for Congress to act, slaves would not have been freed so soon, if at all, due to the voting block of southern states, which sounds quite a bit like the current Republican party. The EO Lincoln issued was a matter of principle. I agree with President Obama that if the Congress doesn’t like his EO on immigration, they should have passed a law.

An Extremely Brief and Absolutely Condensed History of the Establishment Clause

Throughout the history of the US, the US Supreme Court has interpreted the Establishment Clause in three different ways. Initially it was interpreted as strictly not establishing and religion – unless it was certain branches of Protestantism. This of course totally violates what is colloquially known as separation of church and state. Catholic schools were founded because those parents did not want their children learning Protestant teachings. Beginning in 1971 and after, SCOTUS began to interpret the Establishment Clause through a three part test whose major part was excessive entanglement, including if a law had a secular purpose. In reality, it lead to decisions based, I think, on bookkeeping. Since the presidency of George H. W. Bush, all three branches of government have decided the test is endorsement, meaning that as long as a government entity does not favor one religion over the other, it is constitutional. This of course is impossible - there are an endless number of religions. Hopefully, SCOTUS will eventually get it right.

October 17, 539 BCE – Cyrus the Great marches into Babylon and adds it to the Achaemenid Empire that he founded. Cyrus the Great is famous for releasing the Jews from almost 70 years of exile in Babylon caused by the destruction of Jerusalem by Nebuchadnezzar II (Nabucco in Verdi’s opera), with a commission to rebuild the Temple. The Achaemenid Empire was at its time the largest empire the world had ever seen. At its zenith, it included the Near East, most of Southwest Asia, much of Central Asia and the Caucasus, and had about 50 million residents. Cyrus's conquests began a new era in the age of empire building, where a vast superstate, comprising many dozens of countries, races, religions, and languages, was ruled under a single administration headed by a central government that allowed people to continue to worship their own gods and retain their culture. Cyrus is the only Gentile in the Jewish Tanakh (the Christian Old Testament), in the Books of Ezra and Isaiah, called Moshiach, meaning savior or messiah. He is addressed as “…the one to whom "the LORD, the God of Heaven" has given…all the Kingdoms of the earth.” Xenophon wrote “those who were subject to him, he treated with esteem and regard, as if they were his own children,,,What other man but 'Cyrus', after having overturned an empire, ever died with the title of "The Father" from the people whom he had brought under his power? For it is plain fact that this is a name for one that bestows, rather than for one that takes away.” His own people, the Iranians, still refer to him as the Father. The famous Cyrus cylinder, which has sometimes (exaggeratedly) been called the oldest declaration of human rights describes how Cyrus had improved the lives of the citizens of Babylonia, repatriated displaced peoples and restored temples and cult sanctuaries. From mid-August to October 10, 2014, CDC or state public health laboratories have confirmed a total of 691 people in 46 states and the District of Columbia with respiratory illness caused by EV-D68. EV-D68 has been detected in specimens from five patients who died and had samples submitted for testing. In honor of the victims and heroes of 9/11, I will be going dark on my social media sites tomorrow. Not all of the victims died that day; many first responders died within a year of horrible and painful respiratory failure. I am in the 9/11 Health Registry and of course illnesses likely caused by the terrorist attacks still surface, especially cancer and major depression. My then seven year old niece attended PS 89 at the time and saw people jumping from the towers. Adults I know who saw that say they will never forget it. The worst for me was when my then five year old daughter told me that she was afraid that I had died and she would never see me again. I send special gratitude to the psychotherapists who counseled my children and other students. Volunteer lawyers helped families of the deceased to obtain death certificates so that wills, trusts and insurance policies could be processed; the line of volunteers wrapped around the block twice. I send more gratitude to the handlers of the brave rescue dogs who saved many lives. Many of the rescue dogs also died horrible deaths within one year from respiratory illness. But the USA is still here. And always will be.

Steinman Legal News Report January 11. 2014. Franklin McCain -- of 'Greensboro Four,' who defied whites-only barrier -- dies. McCain died Thursday after a brief illness, according to his alma mater, North Carolina A&T State University. He died in a hospital a few miles from the old Woolworth's location -- now the nonprofit International Civil Rights Center and Museum, which opened 50 years to the day McCain and his colleagues began their sit-in on February 1, 1960. The museum posted on its site a tribute to McCain and the other three students for their "courageous act (that) marked a turning point in the struggle for equality that continues to this day."
